According to the revision of the Korean Patent Act of January 8, 2019, a person that infringes a patent right or an exclusive license “on purpose” must compensate damages a maximum of up to 3 times actual damages.
In addition, in order that the person under suspicion of infringement asserts that the person’s technology in implementation is different from the patented invention, the person has to specifically present the technology in its implementation.

The relevant revised Patent Act came into effect on July 9, 2019.
