The
Gist of Revised Patent Act (Effective
from August 21, 2024)
The current Patent Act
allows punitive compensation of up to three times the amount of damage in case
of patent infringement. However, it was necessary
to suppress technology theft and secure the effectiveness of damage relief
because the amount of damage compensation was less than the litigation cost in
the event of patent infringement. The revised Patent Act
raised the upper limit of punitive compensation of up to five times the damages
