When you file a patent application in relation with software inventions in Korea, a device claim, a method claim and a computer readable medium claim can be granted but a program claim has not been allowed.

 

According to the revision of Guidelines which became effective on July 1 2014, a claim in the form of “a program stored in a computer readable medium” can be filed.

 

However, the new Guidelines require the limitation that such program must be stored in a computer readable medium. Therefore, it is notable that the act of online transferring of a program cannot be protected by Patent Law even under the new Guidelines.
