Until now, an amendment or a correction to the specification and/or the drawings under the Korean patent act had to be within the scopes of the descriptions of the Korean specification and/or the drawings originally attached to the Korean patent application.
However, under the revised patent act dated June 11, 2014, the base of an amendment or a correction has been changed in order to harmonize the Korean patent act with international regulations.
In a PCT International patent application filed on or after January 1, 2015, an amendment or a correction to the specification of the Korean patent application is allowed within the scopes of the descriptions of the specification written in the PCT international application language (e.g. English, German, French, Japanese, Chinese, etc.).
Further, in case an English Specification is submitted at the time of filing a Korean patent application(Non-PCT case) on or after January 1, 2015, an amendment or a correction to the specification is allowed within the scopes of the descriptions of the English specification originally attached to the Korean patent application.
Therefore, since a correction of a mistranslation of the specification is allowed when amending a specification, the applicant’s disadvantage due to a mistranslation will be able to be resolved hereafter.
